The pandemic threw 2020 and our priorities into disarray – but make sure you, your business and your employees are aware of the changes to visa, immigration and recruitment rules that came into effect on January 1st 2021.
Here are three things you need to know about the changes that came into force on January 1st:
1) Settled status
If you employ anyone from the EU (excluding Ireland), EEA or Switzerland, make sure they have applied for and received pre-settled or settled status under the EU Settled Status scheme.
The final deadline to apply for this is 30th June 2021. However, only those who arrived in the UK on or before 31 December 2020 will be eligible to apply.
2) New right to work checks
From 1 January 2021 ALL hiring managers must undertake new ‘right to work’ checks – the guidance and legal checklist has changed! It is essential that all hiring managers are aware of the new immigration checks they must complete in order to be legally compliant.
My HR Club is providing the new legally signed-off right to work checklists for its members. Non-members can purchase the checklist from us – email hello@myhrhub.co.uk for more information and to purchase.
3) Sponsorship
Businesses wishing to hire internationally from both EU and non-EU countries will require a sponsorship licence in order to do so under the new UK immigration system. Applications are open and can be done online. My HR Club ran a workshop around this new system in October.
My HR Hub will also be holding a workshop on Tuesday 12 January 2021 at 9am diving into:
- Legal changes as a result of new immigration legislation from 1st January 2021
- How you should conduct interviews and the new right to work in the UK checklists as a result of the new immigration legislation
- How recruiting outside of the UK has now changed – what you need to know
- Q&A’s
This workshop is complementary for My HR Hub clients and My HR Club members. Other tickets are open to all and can purchased for £99 + VAT (payable upfront). Please email hello@myhrhub.co.uk to secure your place.
My HR Club members can also watch a recording of the post-Brexit immigration and visa workshop that was held on 13th October 2020 by Thal Vasishta, founding director of Paragon Law and specialist in Corporate Immigration.
My HR Club members can watch the recording here. Please note: you must have signed in and clicked ‘remember me’ in order to view the recording.
